Chagrin Falls Township Trustees Meeting
Tuesday, December 14, 2004
Minutes

The meeting was called to order by President Stephen Thomas at 7:35 p.m. Those present included Trustee Jeff Homans and Clerk Elizabeth Boles.

MINUTES: The minutes from the last meeting were read. A motion was made, seconded and unanimously passed to accept the minutes as read.

FINANCIAL REPORT: The Trustees acknowledged receipt of the November, 2004 Financial Statement as prepared by Clerk Elizabeth Boles. A detailed report is on file in the Township office.

OLD BUSINESS

BRICK ROAD PROJECT:
• Trustee Homans reported the brick are being laid. He suggested giving the workers a party tray for the Holidays. President Thomas announced he will bring them a large jug of Starbucks coffee.

TOWN HALL RENTALS: No report

TOWN HALL MAINTENANCE: No report.

TOWN HALL STUDY & RENOVATIONS: No report.

COMPREHENSIVE ZONING PLAN: No report.

LOCAL GOVERNMENT FUNDS MEETING:
• There will be another meeting on 12/17 at CSU. Trustees Nazelli will attend this meeting.

504 NORTH MAIN STREET/CHRIS & NEA FOLTZ:
• President Thomas reported a Notice of Appeal has been received from the Foltz’ attorney, John Slager, from Buckingham, Doolittle & Burroughs, appealing the decision announced on November 16, 2004.
• President Thomas will make copies of the Appeal for all BZA members along with a cover letter requesting a transcript within 40 days.
• President Thomas reported he has contacted the Chief of the Civil Division who has assigned an attorney to the Appeal.
• President Thomas went over the necessary steps after receiving the Appeal. The BZA usually meet in a public meeting to approve the minutes from the BZA meeting, and then the Appeal may begin 30 days after approval of those minutes. President Thomas believes the Appeal maybe premature.
• The BZA files the transcript of proceedings. Statutory procedure of filing briefs that depends in part on what the BZA files with the court.
• This is a contest between the Township and the Appellant. The process is in the hands of the attorneys.

NEW BUSINESS

CHAGRIN FALLS LIGHTING FUND:
• A motion was made, seconded and unanimously passed to donate $100.00 to the Fund.

The meeting was adjourned at 8:00 p.m.
